What does a Statutory Declaration of Progress Payment Distribution by Contractor mean?

A statutory declaration known as CCDC 9A/9B, must be used by the contractor or subcontractor as a condition of receiving payment for either the second and subsequent applications for progress payments or the release of holdback monies, must be made.

The use of statutory declaration of progress payment documents contributes to maintaining proper payment distribution up to and including the most recent progress payment received during a building project. 

For the (second and subsequent) progress payments or release of holdback, CCDC 9A/9B is typically a requirement. The declaration must be made in front of a justice of the peace, notary public, or commissioner for oaths. 

What separates CCDC 9A from CCDC 9B?

There are two separate CCDC documents are available. First is the CCDC 9A - 2018 Statutory Declaration of Progress Payment Distribution by Contractor. The Contractor must use the Statutory Declaration of Progress Payment Distribution by Contractor as a sworn declaration before being paid for either the second and subsequent applications for progress payments or the release of holdback monies. 

The second form CCDC 9B - A Statutory Declaration of Progress Payment Distribution by Subcontractor, Form 2018. A sworn document that must be used by the subcontractor as a condition of payment for either the second and subsequent applications for progress payments or the release of holdback monies is called the Statutory Declaration of Progress Payment Distribution by Subcontractor.
